3. Your rights in data protection & right of revocation
Your personal data will be processed in accordance with the provisions of the General Data Protection Regulation (GDPR), the Federal Data Protection Act (BDSG) and other relevant data protection regulations. The processing and use of the individual data is dependent on the agreed or requested service we provide for you. In our contract documents, forms, declarations of consent and other information provided to you (e.g. on the website or in the terms of business) you can find further details and additions to the purposes of processing.

‍3.1 Consent (Art. 6 para. 1 letter a GDPR)
A consent for the processing of personal data, which you have given us, is considered as a legal basis for the mentioned processing. You can revoke your consent at any time with effect for the future.

‍3.2 Fulfilment of contractual obligations (Art. 6 para. 1 letter b GDPR)
Your personal data will be processed for the purpose of carrying out the application procedure. The processing can then also take place electronically. This is particularly the case if you send us your application documents electronically, for example by e-mail or via a web form on the website.

‍3.3 Compliance with legal obligations (Art. 6 para. 1 c GDPR)
We process your personal data, if this is necessary for the fulfilment of legal obligations (e.g. trade, tax laws). These could be, among others: Comparisons with European and international anti-terror lists Compliance with fiscal control and reporting obligations as well as the archiving of data for the purposes of data protection and data security as well as auditing by tax and other authorities.

The RE: GmbH may also use your personal data on the basis of a balance of interests to protect the legitimate interest of us or third parties. This takes place for the following purposes: for advertising or market research, if you have not objected to the use of your data, for obtaining information and exchanging data with credit agencies if this goes beyond our economic risk. for the limited storage of your data, if a deletion is not possible or only with disproportionately high expenditure because of the special kind of the storage; for comparison with European and international anti-terror lists, if this goes beyond the legal obligations; for the safeguarding and exercising of our house rights through appropriate measures (e.g. video surveillance). to complete our contact information, if necessary personal data from public sources (e.g. Internet, media, press, trade and association registers, population registers, debtor registers, land registers). 

‍3.5 Right of appeal to a regulatory authority
‍You have the right to object to the processing of your data at any time for reasons arising from your particular situation if the legal requirements are met. This also applies toprofiling based on this provision within the meaning of Art. 4 No. 4 GDPR. If you object to the processing of your data for advertising purposes or wish to revoke your consent, a short message to our data protection officer by e-mail to privacy@re-digital.io or by post to RE: GmbH, Deutz-Mülheimer Str. 119, 51063 Cologne, Germany. Your data will then no longer be processed for the advertising purposes covered by the objection or revocation of consent. This also applies to profiling insofar as it is connected with such direct advertising. This does not affect the legality of the processing carried out up to the point of objection or revocation. After your objection to the processing of your personal data for advertising purposes or the revocation of your consent, we are obliged under data protection law in accordance with the requirements of the German data protection regulatory authorities to include the necessary data(name, address, e-mail address) in our internal blocking list and permanently -only for this purpose - store (block) and use for comparison with our futureadvertising files (Art. 21 para. 3, Art. 17 para.3 b, Art. 6 para. 1 c GDPR). This will ensure that your objection or the revocation of your consent is observed on a permanent basis. If you have any questions about the processing of your personal data by us, we will of course be happy to provide you with information about the data concerning you at any time.

Furthermore, you have the right to information according to Art. 15 GDPR, the right to correction according to Art. 16 GDPR, the right to deletion according to Art. 17 GDPR, the right to limitation of processing according to Art. 18 GDPR as well as the right to data transfer from Art. 20 GDPR if the legal requirements are met. Finally, you have the right to lodge a complaint (Art. 77 GDPR) with a competent data protection regulatory authority.

4. Categories of personal data processed by us

Cookies
Our website does not use web analysis technologies to collect and use data for marketing and optimization purposes.

‍Contact form
If you get in touch with us via email, your details will be stored by us for the purpose of processing the enquiry and in the event of follow-up questions. This data will not be passed on without your consent. The processing of the data entered in the contact form is therefore carried out exclusively on the basis of your consent (Art. 6 para. 1 lit. a GDPR). You can revoke this consent at any time. For this purpose, an informal e-mail to us is sufficient. The legality of the data processing operations carried out until the revocation remains unaffected by the revocation. The data you send with your e-mail request or demo booking will remain with us until you request us to delete it, revoke your consent to storage or the purpose for data storage no longer applies (e.g. after your request has been processed). Mandatory legal provisions - in particular retention periods - remain unaffected.

‍Inquiry by e-mail, telephone or fax
If you contact us by e-mail, telephone or fax, your request including all personal data (name, request) will be stored and processed by us for the purpose of processing your request. We do not pass on this data without your consent. This data is processed on the basis of Art. 6 Para. 1 lit. b GDPR if your request is related to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, processing is based on your consent (Art. 6 para. 1 lit. a GDPR) and / or on our legitimate interests (Art.6 para. 1 lit. f GDPR), as we have a legitimate interest in the effective processing of enquiries addressed to us. The data you send us via contact requests will remain with us until you request deletion, revoke your consent to storage or the purpose for data storage no longer applies (e.g. after yourrequest has been processed). Mandatory statutory provisions - in particular statutory retention periods - remain unaffected.

Processing of data (customerand contract data)
We collect, process and use personal data only to the extent necessary for the establishment, content design or modification of the legal relationship (inventory data). This is done on the basis of Art. 6 para. 1 lit. b GDPR, which permits the processing of data for the fulfilment of a contract or pre-contractual measures. We collect, process and use personal data relating to the use of our Internet pages (usage data) only to the extent necessary to enable the user to make use of the service or to bill the user. The collected customer data will be deleted after completion of the order or termination of the businessrelationship. Legal retention periods remain unaffected. The following data can beprocessed:

5. Processing of personal data

Your personal data will be passed on by us within our company to those areas which require this data to fulfil their contractual and legal obligations or to implement our legitimate interest. In addition, the following offices may receive your data:
a. contract processors used by us (Art. 28 GDPR) in particular in the following areas: IT services, logistics     services, suppliers, external computer centres, controlling, auditing services, financial institutions, courier services and logistics
b. public bodies and institutions where there s a legal or official obligation under which we are obliged to provide information, report or pass on data or where the passing on of data is in the public interest
c. other bodies for which you have given us your consent to data transfer (e.g. dealers or business partners)

6. What are required fields?

If certain data fields are designated as mandatory fields and/ or marked with an asterisk ( * ), the provision of this data is either required by law or contract, or we need this data for the conclusion of the contract, the desired service or the stated purpose. Of course, you also have the right to specify the data in the mandatory fields at your discretion. Failure to provide this information may result in the contract not being fulfilled by us or the desired service not being provided or the stated purpose not being achieved.

7. How long do we store your data?

We need your data for the duration of your visit to our website. Your data is stored regularly for the duration of your browser session. In addition, log files are stored by us for ashort period of time in order to identify faults and for security reasons and then deleted. Log files whose storage is necessary for evidence purposes, are excluded from deletion until the final clarification of the respective incident. In individual cases, data may be passed on to investigating authorities.

‍Extended storage periods
‍The specified storage periods may be extended accordingly if a longer statutory or contractual storage period exists inindividual cases, in particular if the data are processed for different purposes.

8. To what extent is there automated decision-making in individual cases (including profiling)?

We do not use purely automated decision-making procedures in accordance with Article 22 GDPR. Should we use these procedures in individual cases, we will inform you of this separately if this is required by law.

9. Data Processing through Social Networks

We maintain publicly accessible profiles on social networks. The social networks used by us in detail can be found below. Social networks such as Twitter etc. can generally analyze your user behavior extensively when you visit their website or a website with integrated social media content (e.g.like buttons or advertising banners). Visiting our social media presences triggers numerous processing operations relevant to data protection.

In detail: If you are logged into yoursocial media account and visit our social media presence, the operator of the social media portal can assign this visit to your user account. However, your personal data may also be collected under certain circumstances if you are not logged in or do not have an account with the respective social media portal. In this case, this data collection takes place, for example, via cookies that are stored on your end device or by recording your IP address.With the help of the data collected in this way, the operators of the social media portals can createuser profiles in which your preferences and interests are stored. In this way, you can be shown interest-based advertising inside and outside the respective social media presence. Provided you have an account with the respective social network, the interest-based advertising may be displayed on all devices on which you are or were logged in. Please also note that we cannot track all processing on the social media portals. Depending on the provider, further processing operations may therefore be carried out by the operators of the social media portals. ‍Legal basis
Our social media presences are intended to ensure the most comprehensive presence possible on the Internet. This is a legitimate interest within the meaning of Art. 6 (1) lit. f GDPR. The analysis processes initiated by the social networks may be based on different legal bases, which are to be specified by the operators of the social networks (e.g. consent within the meaning of Art. 6 (1) lit. a GDPR).

‍Responsible party and assertion of rights
If you visit one of our social media sites, we are jointly responsible with the operator of the social media platform for the data processing operations triggered during this visit. In principle, you can assert your rights (information, correction, deletion, restriction of processing, data portabilityand complaint) both vis-à-vis us and vis-à-vis the operator of the respective social media portal. Please note that despite the joint responsibility with the social media portal operators, we do not have full influence on the data processing operations of the social media portals. Our options are largely determined by the corporate policy of the respective provider.

‍Storage period
The data collected directly by us via the social media presence will be deleted from our systems as soon as the purpose for storing it no longer applies, you request us to delete it, revoke your consent to store it, or the purpose for storing the data no longer applies. Stored cookies remain on your terminal device until you delete them. Mandatory legal provisions - in particular retention periods - remain unaffected. We have no influence on the storage period of your data, which is stored by the operators of social networks for their own purposes. 10. Services

10.1 Calendly

You can make appointments with us on our website. We use the “Calendly” tool for booking appointments. The provider is Calendly LLC, 271 17th St NW, 10th Floor, Atlanta, Georgia 30363, USA (hereinafter “Calendly”).

To book an appointment, enter the requested data and the desired date in the screen provided. The data entered will be used for planning, executing and, if necessary, for the follow-up of the appointment. The appointment data is stored for us on the servers of Calendly, whose privacy policy can be viewed here: https://calendly.com/privacy.

The data you have entered will remain with us until you ask us to delete it, revoke your consent for storage or the purpose for which the data was stored ceases to apply. Mandatory legal provisions, in particular retention periods, remain unaffected.

The legal basis for data processing is Art. 6(1)(f) GDPR. The website operator has a justified interest in making appointments with interested parties and customers in as uncomplicated a manner as possible. If appropriate consent has been obtained, the processing is carried out exclusively on the basis of Art. 6(1)(a) GDPR and § 25 (1) TDDDG, insofar the consent includes the storage of cookies or the access to information in the user’s end device (e.g., device fingerprinting) within the meaning of the TDDDG. This consent can be revoked at any time.

The company is certified in accordance with the “EU-US Data Privacy Framework” (DPF). The DPF is an agreement between the European Union and the US, which is intended to ensure compliance with European data protection standards for data processing in the US. Every company certified under the DPF is obliged to comply with these data protection standards. Data processing
We have concluded a data processing agreement (DPA) for the use of the above-mentioned service. This is a contract mandated by data privacy laws that guarantees that they process personal data of our website visitors only based on our instructions and in compliance with the GDPR.

10.2. Newsletter / Brevo

Newsletter data
If you would like to receive the newsletter offered on the website, we require an e-mail address from you as well as information that allows us to verify that you are the owner of the e-mail address provided and that you agree to receive the newsletter. Further data is not collected or only on a voluntary basis. For the handling of the newsletter, we use newsletter service providers, which are described below.

Brevo

This website uses Brevo for the sending of newsletters. The provider is the Sendinblue GmbH, Köpenicker Straße 126, 10179 Berlin, Germany. Brevo services can, among other things, be used to organize and analyze the sending of newsletters. The data you enter for the purpose of subscribing to the newsletter are archived on servers of Sendinblue GmbH in Germany.

Data analysis by Brevo
Brevo enables us to analyze our newsletter campaigns. For instance, it allows us to see whether a newsletter message has been opened and, if so, which links may have been clicked. This enables us to determine, which links drew an extraordinary number of clicks.

Moreover, we are also able to see whether once the e-mail was opened or a link was clicked, any previously defined actions were taken (conversion rate). This allows us to determine whether you have made a purchase after clicking on the newsletter.

Brevo also enables us to divide the subscribers to our newsletter into various categories (i.e., to “cluster” recipients). For instance, newsletter recipients can be categorized based on age, gender, or place of residence. This enables us to tailor our newsletter more effectively to the needs of the respective target groups.

If you do not want to permit an analysis by Brevo, you must unsubscribe from the newsletter. We provide a link for you to do this in every newsletter message. Moreover, you can also unsubscribe from the newsletter right on the website.

Legal basis
The data is processed based on your consent (Art. 6(1)(a) GDPR). You may revoke any consent you have given at any time by unsubscribing from the newsletter. This shall be without prejudice to the lawfulness of any data processing transactions that have taken place prior to your revocation.

Storage period
The data deposited with us for the purpose of subscribing to the newsletter will be stored by us until you unsubscribe from the newsletter or the newsletter service provider and deleted from the newsletter distribution list after you unsubscribe from the newsletter. Data stored for other purposes with us remain unaffected.

After you unsubscribe from the newsletter distribution list, your e-mail address may be stored by us or the newsletter service provider in a blacklist, if such action is necessary to prevent future mailings. The data from the blacklist is used only for this purpose and not merged with other data. This serves both your interest and our interest in complying with the legal requirements when sending newsletters (legitimate interest within the meaning of Art. 6(1)(f) GDPR). The storage in the blacklist is indefinite. You may object to the storage if your interests outweigh our legitimate interest.

Data processing
We have concluded a data processing agreement (DPA) for the use of the above-mentioned service. This is a contract mandated by data privacy laws that guarantees that they process personal data of our website visitors only based on our instructions and in compliance with the GDPR.

10.3. WebinarGeek 

RE: GmbH uses the WebinarGeek software for the organization, implementation and follow-up of webinars. The provider is WebinarGeek, Chroomstraat 12, 2718 RR Zoetermeer, Netherlands. WebinarGeek acts as our processor in this context. In this context, please also note WebinarGeek's data protection information: https://www.webinargeek.com/de/datenschutzerklarung

RE: GmbH is responsible for data collection and processing in the context of webinars. 

We collect and process the following personal data from persons who register for or participate in our webinars: 

· Information about the webinar participant: first name, last name, e-mail address, time of registration, company/organization

· Webinar metadata: Topic, if applicable, description, device/hardware information, IP address and the active time the window was open. 

· Text data: If a webinar participant uses the chat, question or survey function, the text entries made by the respective participant are processed and logged. If questions are asked that are answered as part of the follow-up to a webinar, the questions and the participants’ e-mail addresses are processed to be able to answer them afterwards. 

Automated decision-making does not take place. 

Legal basis
The processing of personal data via WebinarGeek takes place within the scope of your consent, the legal basis is Art. 6) 1) a) GDPR and § 25 para. 1 TTDSG (German law), insofar as the consent includes the storage of cookies or access to information in the user's terminal device (e.g. device fingerprinting) within the meaning of the TTDSG. Consent can be revoked at any time. In the case of the implementation of pre-contractual measures, the legal basis is Art. 6) 1) b) GDPR. The offer and organization of webinars via WebinarGeek and the follow-up and further development are carried out based on Art. 6) 1) f) GDPR. RE: GmbH has a legitimate interest in further developing its offering. 

When using WebinarGeek, no personal data is transferred to third countries. 

Storage duration
The personal data processed as a result of conducting webinars will be stored for as long as is necessary to fulfill the above-mentioned purposes, taking into account statutory retention periods. Personal data we received as part of a webinar will generally be stored for 2 years. 

11. Data Security
We take technical and organizational security precautions to protect your personal data against accidental or intentional manipulation, loss, destruction or against access by unauthorized persons and to ensure the protection of your rights and compliance with the applicable data protection regulations of the EU and the Federal Republic of Germany. The measures taken are intended to ensure the confidentiality and integrity of your data and to ensure the availability and resilience of the systems and services when processing your data on a permanent basis. They are also intended to quickly restore the availability of and access to the data in the event of a physical or technical incident. Our security measures also include encryption of your data. All information that you enter online is technically encrypted and only then transmitted. This means that this information cannot be viewed by unauthorized third parties at any time. Our data processing and security measures are continuously improved in line with technological developments. The employees of the RE: GmbH are or will be obligated in writing to maintain confidentiality and to comply with the data protection requirements of the GDPR.

‍SSL encryption
To protect the security of your data during transmission, we use state-of-the-art encryption procedures (e.g. SSL) via HTTPS.

12. Changes
The privacy policy must be adapted from time to time to the actual circumstances and to the legal situation. Please check the privacy policy in each case before using our application portal.
